Article 1 – Definitions

The following definitions apply in these general terms and conditions:

  • Cancellation period: the period during which the consumer can exercise their right of withdrawal;

  • Customer: the natural person who does not act in the exercise of a profession or business and enters into a distance contract with the entrepreneur;

  • Day: calendar day;

  • Ongoing obligations: a distance contract concerning a series of products and/or services;

  • Right of withdrawal: the consumer's option to dissolve the distance contract within the withdrawal period;

  • Entrepreneur: the natural or legal person who offers products and/or services at a distance to consumers;

  • Distance sales contract: a contract in which one or more techniques for distance communication are exclusively used;

  • General terms and conditions: these general terms and conditions of the entrepreneur.

Article 3 – Applicability

These general terms and conditions apply to every offer from the entrepreneur, as well as to every distance contract and all orders between entrepreneur and consumer. Before the contract is concluded, the text of these terms and conditions is made available to the consumer.

Article 4 – The offer

If an offer has a limited validity period, this will be explicitly stated. The entrepreneur has the right to modify the offer. The offer contains a complete description of the products. Obvious errors in the offer do not bind the entrepreneur. Prices in the offer exclude customs clearance costs and import taxes; these additional costs are the responsibility of the customer when importing from outside the EU.

Article 5 – The contract

The contract is concluded at the moment the consumer accepts the offer and meets the stated conditions. Upon electronic acceptance, the entrepreneur confirms receipt without delay.

Article 6 – Right of withdrawal

When purchasing products, the consumer has the option to dissolve the contract without giving reasons within 30 days. This period starts the day after receipt. The consumer must handle the product and packaging with care. Returns must be sent within 5 days after notification. Note: returns to our supplier in China are at the consumer's own expense.

Article 7 – Costs upon cancellation

If the consumer exercises their right of withdrawal, the costs of returning the goods are borne by the consumer. The entrepreneur will refund the order amount within 5 days after proper receipt of the goods.

Article 8 – Exclusion of the right of withdrawal

The entrepreneur may exclude the right of withdrawal for specific products (such as custom-made items, hygiene products whose seal has been broken, or products that spoil quickly), provided this is clearly stated in the offer.

Article 9 – The price

Prices will not be increased during the validity period, except for statutory VAT changes. Delivery takes place outside the EU, so the postal or courier service may charge VAT or customs clearance fees to the customer. No VAT is charged to the entrepreneur.

Article 10 – Conformity and warranty

The entrepreneur guarantees that the products comply with the contract and the stated specifications. Defects must be reported in writing within 30 days after delivery. The warranty expires in case of self-repair or careless use.

Article 11 – Delivery and execution

The entrepreneur executes orders with due speed, no later than within 30 days. If delivery proves impossible, the entrepreneur will make efforts to provide a replacement item. The risk of damage rests with the entrepreneur until the moment of delivery.

Article 12 – Fixed-term contracts

Contracts for an indefinite period can be terminated at any time with a notice period of up to one month. Temporary contracts cannot be tacitly extended for a fixed term.

Article 13 – Payment

Amounts must be paid within 7 working days after the start of the withdrawal period, unless otherwise agreed. Errors in payment details must be reported immediately.

Article 14 – Complaints procedure

Complaints about the execution of the contract must be submitted fully and clearly described within 7 days after discovery. The entrepreneur will respond within 30 days.

Article 15 – Disputes

Only Dutch law applies to contracts between the entrepreneur and the consumer, even if the consumer lives abroad.
